The Abuja division of the Court of Appeal on Wednesday reserved judgment in the appeal brought by the All Progressives Congress (APC) and its candidate, Hon. Chike Okafor, seeking to nullify the judgment of the High Court of the Federal Capital Territory (FCT) which produced Emeka Nwajiuba of the Accord Party, as a member of representing Ehimembano/Ihiteuboma/Obowo Federal constituency of Imo State.
The three-man panel of the appellate court, namely: Justice Adamu Jauro, Stephen Adah and Justice Wison Akomolafe arrived at the decision after rejecting moves by Barr. Kingdom Okere, counsel for Emeka Nwajiuba, to terminate the appeal.
The panel insisted on hearing the appeal on its merit, the court however reserved judgment at a later date which will be communicated to the parties.
In the multiple appeals, the appellants are challenging the decision of Justice Bello Kawau of the Bwari division of the FCT High Court which had barred the Independent National Electoral Commission, INEC, from accepting or listing the candidate of the APC in the rescheduled National Assembly election.
The said order issued on February 12, 2019, gave rise to the eventual emergence of Nwajiuba as the member representing Ehimembano/Ihiteuboma/Obowo Federal constituency in controversial circumstances.
In the appeal proper, Okafor had throuh his counsel, Solomon Umoh (SAN) urged the Court of Appeal to nullify the decision of the trial court on the grounds that it erred in in law in holding that he was functus officio to set aside his order of April 29, 2019 and the entire proceedings in suit No. FCT/HC/CV/423/2018.
Canvassing arguments in the appeal which is predicated on seven grounds, Umoh submitted that the decision of April 29, 2019 and the entire proceedings in the suit is a nulity as it was made without jurisdiction adding that a court can never be functus officio to set aside or revisit its null orders.
The appellant contended that the refusal to set aside his orders of April 29 as well as the entire proceedings in the suit has occasioned a miscarriage of justice.
Umoh further told the court that his client was never made a party to the suit and Mrs. Uzoma Chioma Mary Ann who originated the suit knew that the he and not Emeka Nwajiuba (3rd respondent) was the candidate of the APC for the Federal constituency seat.
He submitted that the order made by the judge on April 29, 2019 was against the appellant, who was not a party before the court.
The orders made by the court on April 29, 2019 were made without jurisdiction as they were made well outside theb180 days permitted by the 4th alteration to the 1999 constitution for the trial court to conclude pre-election matters.
The orders were made after the election at a time Emeka Nwajiuba who is now the beneficiary had filed an election petition at the National Assembly Election Tribunal in Owerri challenging the return of the appellant.
That the orders of the lower court were completely at variance with its ruling of April 29, whereas the court restrained the Independent National Electoral Commission (4th respondent) from recognizing Emeka Nwajiuba as a candidate in the 2019 election, the same court in its orders of April of April 29, 2019 directed INEC to issue certificate of return to the same Emeka Nwajuba.
That Nwajiuba suppressed information at the lower court when he refused to informed the court that at all material times to the suit, he had ceased to be a member the APC and was the candidate of Accord Party in the election.
On his part, the National Legal Adviser of the APC, Babatunde Ogala urged the appellate court to allow the appeal and set aside the judgment of the lower court.
The legal Adviser also asked the Court of Appeal to hold that the lower court lacked the jurisdiction to determine a pre- election matters outside its geographical area under the provisions of section 257 of the 1999 constitution.
The party submitted that both the decision of February 12, 2019 which gave birth to the ruling of April 29, 2019 were barred by statute having been made outside the mandatory period allowed by law.
The legal action was commenced at the trial court by a House of Representatives aspirant, Mrs. Uzoma Chioma Ann, who had filed a suit before the High Court against the APC, Emeka Nwajuba and the Independent National Electoral Commission.
Among other reliefs, she sought for the nullification of the nomination of Chukwuemeka Nwajiuba, as its candidate for the Okigwe South Federal Constituency for the 2019 elections.
According to her, Nwajiuba’s emergence violated the party’s rules and guidelines.
Justice Kawu in his ruling, cited various authorities and concluded that Nwajiuba’s nomination was “inappropriate, unlawful, null and void for failure to comply with the first defendants guideline for nomination of candidate.”
He also barred INEC “from further recognising, accepting or listing Nwajiuba’s (second defendant) name as the candidate of the first defendant in the 2019 ballot paper for Okigwe South House of Representatives election because the first defendant (APC) did not conduct primary for the office.
Ironically, Chika Okafor, who was the nominated candidate of the APC for the Federal seat was not made a party in the suit and denied the opportunity of being heard.
While the suit was pending before the court, Emeka Nwajiuba joined the Accord Party where he contested the elections against Chika Okafor of the APC, who won the election and was issued with a certificate of return by INEC.
It was after the issuance of the Certificate- of- Return on Okafor that his attention was drawn to the suit pending at the Kubwa division of the FCT High Court.
Having become aware of the suit, Okafor approached the court seeking to set aside the entire proceedings as well as any order emanating there from and for injunctive orders against INEC in respect of Ehimembano/Iiteuboma/Obowo Constituency of Imo state.
While the said application was pending for hearing, Nwajuba who contested and lost the election and lost to Okafor, approached the FCT High Court on April 29, 2019 to compel the INEC to enforce its ruling delivered of February 12 2019.
Consequently, the electoral body in compliance with the said ruling of the FCT High Court issued a certificate of return to Nwajuba of the Accord Party as the elected member of the federal constituency.
President Muhammadu Buhari yesterday approved a new official portrait for display in public offices, buildings and for other legitimate purposes.
In a statement issued by office to the secretary to the government of the federation (SGF), the president directed ministries, departments, and agencies (MDAs), sub-national entities, businesses and the public to obtain the soft copy of the portrait.
Also, the sample copy of the new official portrait can be viewed and downloaded from the website of the office of the SGF .
There was palpable anxiety at the Lagos Airport on Friday when an unknown man carrying a bag climbed the fuselage of the aircraft.
The aircraft which had passengers on board was parked at the apron preparatory for taxing through the taxiway into the runway for take-off .
Having beaten the security surveillance to gain access to the apron, the man climbed the parked aircraft through the dude to hang at the compartment housing the fuel tank.
Passengers onboard the aircraft who recorded the unauthorized activities were confused shouting and unsure of what might happen next.
officials of Federal Airports Authority of Nigeria ( FAAN) said the man has been arrested and taken to an isolated around the Lagos Airport called Tango City.
The incident has provoked questions about the porosity of the Lagos Airport where rising cases of stowaway and other unauthorized activities are commonplace.
It has also raised concerns about the vulnerability of the premier gateway without adequate perimeter and security fences.
The presidency has appealed to El-Zakzaky-led Shiite members to desist from needless violent street protests and await the decision of the court in Kaduna where their leader is currently being tried.
The issue of El-ZakZaky,according to a statement by Garba Sheu, President Buhari’s media aide, is before the court in Kaduna and his supporters should focus on his on-going trial instead of causing daily damages, disruptions and public nuisance in Abuja.
“It is wrong to be in court and resort to violence at the same time in order to get justice for anybody accused.
The destruction of public property in the name of protest is not within the right of this group of Shiite members and no government anywhere would have tolerated a situation where any group would take over public roads in cities as they have done in Abuja and interfere with the rights of other citizens who are prevented from reaching their destinations.
We imagine a situation where families are taking their loved ones to hospital for emergency treatment and they are held up needlessly by the protesters. No government anywhere in the world would turn a blind eye to this unlawful behavior.
As far as this country’s Ministry of Justice is concerned, the case involving El-Zakzaky is no longer in its domain. The Federal Government no more has hands in the matter and to that extent, the government at the centre can be said to be clear of any alleged violations of court orders as being trumpeted everyday.
These rallies and street dances ostensibly to openly insult the President and other leaders, threatening bloodshed will lead nowhere because President Buhari will not ask the country’s judiciary to abandon due process and set a suspect free. At the same time, the administration is determined to enforce the decision of the court clearly issued. The Buhari administration has absolutely no hand in the on-going court case and the courts are free to determine the bail request and the final outcome.
The mentality that you are above the law and that your own rights are superior to other people’s rights is unacceptable.
You can’t be provoking other citizens by interfering with their own rights on public roads and disrupting their businesses and call it democratic freedom. In democratic traditions, their rights end where the rights of others begin.
Law abiding citizens must avoid deliberate lawlessness. It is not within the rights of any group to enter protected public institutions such as the National Assembly by force to attack police and destroy public and private property.
It is always advisable to embrace dialogue and eschew violence in all our actions so that we can continue to live together in peace.
We therefore appeal to the Shiite group to stop deliberate provocations that result in violence and fatalities and allow the trial of El-ZakZaky to take its course,” the statement reads.

Military authorities have placed immediate-past General Officer Commanding (GOC), 8 Division, Sokoto, Major General Hakeem Otiki, under house arrest after some soldiers carted away at least N400 million under his watch.
Otiki, who was redeployed to Administrative Staff College of Nigeria (ASCON), is being detained in the Officers Mess until he can be moved to Abuja for interrogation by personnel from the Directorate of Military Intelligence (DMI), Special Intelligence Bureau (SIB), and Nigerian Army Corps of Military Police (NACMP).
He is reportedly being guarded by heavily armed soldiers who are carefully screening his visitors.
The commanding officer was said to have detailed five soldiers to transport huge sums of money on July 11.
The soldiers – two corporals and three lance corporals – moved the money from Sokoto to the Nigeria Army airstrip in Jaji, Kaduna State.
Although instructed to load the money unto a military jet for transport to Abuja, the soldiers failed to do so but instead shared it among themselves and disappeared, Premium Times reported.
The soldiers reportedly dropped their rifles, uniforms and other accouterments, and mobile phones before vanishing into thin air with the money.
However, controversy continue to trail the source of the stolen fund.
While some say the money may have been gotten from proceeds of illegal bunkering, others say the money was meant to pay troops allowances who have have not been paid in the last two months.
A columnist with The Punch newspaper, Abimbola Adelakun, was on Sunday questioned by security men at the Commonwealth of Zion Assembly, in Abuja.
The church’s senior pastor, Biodun Fatoyinbo, was recently accused of rape by Busola, wife of singer Timi Dakolo.
Adelakun, who said she was at the church on Sunday in furtherance of her research on Pentecostal churches, said she was pulled out of the church by the church’s security men, who recognised her, and made her to stay in “one place where they were keeping everybody that they suspected.”
The columnist said her demand to be allowed to leave was refused by the security men.
She said the matter has been taken to a Police station in Abuja.
On her Twitter handle, @Adunnibaby, the columnist wrote, “I’m aware of the info abt my arrest at COZA today. I wasn’t arrested. Earlier, I sent out an image bcos I was concerned when pulled aside by the protocol dept for questioning. Thanks to everyone who has been concerned about me. I am sorry for all the misinformation out there.”
Armed bandits have allegedly abducted four Turkish expatriates at a local drinking joint in Gbale village, Edu local government area of Kwara State.
The incident, it was gathered occurred at about 10pm, on Saturday while the men were having fun at the local joint in the village.
The names of the abductees are Yasin Colak (33), Senerapal (40), Ergun Yurdakul (35) and Seyit Keklik (25).
The victims are said to be expatriates working with Instabul concrete limited in the village.
Spokesperson of the Kwara Police Command Ajayi Okasanmi confirmed the abduction of the expatriates.
He added that Commissioner of Police Kayode Egbetokun had dispatched team under operation Puff Adder to the area to commence immediate rescue alive of the expatriates and arrest of the hoodlums.
He added that the efforts of the police is beginning to yield positive results but did not confirm if any arrest had been made so far.
Abdulrahman Abdulrazaq, governor of Kwara state, says he is working closely with the security agencies to ensure the abducted Turkish nationals are rescued.
In a statement issued on Sunday, by Rafiu Ajakaye, his press secretary, the governor urged residents to be calm and go about their normal and lawful businesses.
“The Governor is working closely with the security agencies to ensure prompt rescue of the expatriates,” the statement read.
“The Governor urges the people to go about their normal and lawful businesses and not to entertain any fear, as doing so may embolden the criminals behind the development.”
The police had earlier confirmed that a gang of suspected kidnappers abducted four expatriates along Gbugbu-Lafiagi road on in Edu local government area of the state on Saturday night.
Ajayi Okasanmi, the public relations officer of the state police command, gave the names of the gang members as Seyit Keklik (25), Yasin Colak (33), Ergun Yurdakul (35), and Senerapal (40).
It was gathered that the abducted expatriates were working at a quarry site located within the area.
A source said that they were on their way back from Gbugbu market, where they had gone to buy energy drinks, to Gbale, a village where the quarry is located.
According to the source, the kidnappers waylaid them and took them to an unknown destination.
The police spokesman said that efforts had begun to rescue the abductees. Okasanmi added that it was already yielding positive results.
Timi Dakolo has insisted that he never discussed his wife’s virginity with anyone neither did he do that with any media house.
He asked ‘anyone with proof to show the world at what occasion I said that”.
The singer made the statement during a press parley with journalists on Sunday.
The embattled singer stressed he himself wondered where the news came from as he never granted any such interview.
He, however, mentioned that it was fabricated by the enemies, who were also responsible for the news that he got wedded at the COZA church and that he also received cash running into millions from the pastor of the church, Biodun Fatoyinbo.
Timi Dakolo who spoke on behalf of his wife at the parley added that said the officers who stormed his home on Saturday were there to abduct his wife.
He claimed that she was trailed home by the policemen.
A week before the end of his tenure in May 2019, the then Governor of Oyo State, Abiola Ajimobi, pardoned an official of the Oyo State Ministry of Justice, Yewande Oyediran, who was sentenced to seven years in prison for killing her husband, Lowo.
Oyediran, who was a lawyer, was in November 2017, convicted for manslaughter by Justice Muntar Abimbola of the Oyo State High Court, sitting in Ibadan, Oyo State.
She killed her husband with a knife after a disagreement on February 2, 2016, at their residence in the Akobo area of Ibadan. The disagreement was said to have arisen after Yewande accused her late husband of infidelity.
However, a few days before leaving office, Governor Ajimobi granted the convict amnesty.
Speaking on Sunday, the Attorney-General of Oyo State under Ajimobi, Mr. Seun Abimbola, said the governor had the constitutional right to grant amnesty to any convict.
He however, said Ajimobi did not exercise the power arbitrarily as it was being insinuated.
Abimbola said on the day the convict was pardoned, 49 other persons were also freed by Ajimobi.
The former commissioner for justice said a committee was set up to look into the petitions of 400 persons who had pleaded for clemency.
He said the committee comprised commissioners, officials of the Department of State Services and other government agencies which then advised the government.
The former AG dismissed reports that the convict was pardoned because of her former position as an official of the ministry of justice and the influence of her family.
Abimbola said, “The issue of clemency by any government is constitutional but the exercise of that power is not arbitrary. It is based on the recommendation of the committee on the prerogative of mercy.
“The committee is chaired by the attorney-general and also has DSS officers, the police, the chaplain and the chief imam of the Government House, Legal Aid Council, Director, Legal Affairs, the Solicitor-General and the Directorate of Public Prosecution are members. So, it was not an arbitrary decision.
The lady in question is just one out of 50 that were pardoned. And the 50 that were pardoned were drawn out of 400 that were considers. So, she was not singled out as some are insinuating. Even the prisons authorities brought recommendations on the good behaviour of those pardoned.”
Abimbola maintained that Oyediran had already served half of her sentence and the governor decided to show her mercy since she was not convicted of premeditated murder.
He explained that nine months in prison is equal to a year, adding that her sentence began counting from the day she was detained.
The former commissioner added, “She was arrested in 2016 and her sentence started reading from the day she was arrested. A year in prison is nine months. She was not convicted for murder but for manslaughter. It was a fight between a husband and a wife which resulted in death.
“People should stop saying she killed her husband as if it was premeditated. The amnesty was not a secret one. We did it every May 29 and even the new governor pardoned convicts on June 12.”

Many argued that were the convict a man, he would not have been released so early from prison.

The Alaafin of Oyo, Oba Lamidi Adeyemi, has written to President Muhammadu Buhari to warn him about looming anarchy in the country if the siege laid to Yorubaland by herdsmen and kidnappers is not contained. Adeyemi, who catalogued the spate of insecurity in Yorubaland by herdsmen and their collaborators, accused Buhari of not bringing the culprits to book.
He said the Yoruba had all it took to resort to self-help if the security in the zone did not improve and people guaranteed safety of lives and property.
Titled, ‘Yoruba Question in Nigeria Conundrum,’ Alaafin wrote, “I have never been timid or failed in my total support for the success of your administration. My confidence had always been based on Your Excellency’s ability, fitness and competence in leading the country to the Promised Land, where law and order will prevail, individual liberty is guaranteed and economic wellbeing of the citizens is assured.
“In recent time, however, I am worried about the security situation in the country, especially in the South-West geo-political zone, nay the entire Yoruba-speaking area of the country, including Kwara, Kogi and Edo states.
“This has to do with the menace of Fulani herdsmen that have laid siege to almost all the highways of Yorubaland. Whether in Owo, Akure, Ilesa/Ife-Ibadan road or Ibarapa zone and the Ijebu area of Ogun State, the story is the same.
“I have held a series of consultations with opinion moulders and eminent Yoruba leaders about the menace of these cattle herdsmen with assault such as raping of our women and on some occasions, in the presence of their husbands. That is apart from massive destruction of our agricultural land, which ultimately points to imminent starvation.
“On top of it all is the menace of professional kidnappers usually in military uniforms. What is more worrisome about the kidnapping notoriety is the impunity with which these kidnappers go about their nefarious activities.”
Alaafin said people were worried by the audacity of the lawless people in effecting their illegal acts in broad daylight on bushy highways without any arm of security being able to do anything.
Though distraught, Mrs. Gift Ideh, the mother of Tuoyo, the physiotherapist and stripper who was the only evicted housemate in the third week of the Big Brother Naija reality show, has said she was not unhappy but grateful to God her son made her proud while his stay lasted in the house.

Many people were injured in a violent clash between the members of the Islamic Movement of Nigeria (IMN), popularly known as Shiite, and the police on Monday.

The Inspector-General of Police, Mohammed Adamu, has ordered that petitions from the Senior Pastor of the Commonwealth of Zion Assembly, Abuja, Biodun Fatoyinbo, and the Dakolos, be merged and investigated at the Force Criminal Investigation and Intelligence Department, Alagbon, Ikoyi, Lagos.
Lawyer to the Dakolos, Mr Femi Falana, made the revelation during a telephone conversation with The Punch on Monday.
Falana, a Senior Advocate of Nigeria, told our correspondent that the IG had assured that justice would be done in the matter.

Massive raids of the Abuja environs by the Nigeria Police to arrest protesting members of the Islamic Movement of Nigeria a.k.a Shi’ite, have been scheduled to begin soon, following the killing of a deputy commissioner of police on Monday evening, according to a very reliable source.
DCP Umar Belel was reportedly shot by one of the irate protesters who had gone to pacify them to be orderly.
The source said the raids would be conducted within the FCT, over multiple days, to fish out criminals members of the Shi’ite, who had resorted to using dangerous weapons against peaceful protest.
DCP Umar, who was in charge of Operations at the Federal Capital Territory Police Command, was shot dead as he tried to pacify angry Shi’ite members whose protest partially grounded commercial activities and vehicular movement around the Federal Secretariat, Abuja on Monday.
He was immediately taken to an undisclosed hospital where he gave up the ghost.
